EXTENDED LIMITED WARRANTY

1 Year Serial

This Extended Limited Warranty (“Extended Warranty”) is agreed to by Customer for the Term as listed on Sales Receipt, above, and upon the terms and conditions set forth herein.

1. Extended Warranty. RefurbKings warrants to the original Customer only that the product will be free from defects in materials and workmanship for the “Term”. If during the Term the product is not free from defects in materials and workmanship, RefurbKings will, at its sole option: (i) repair the product; (ii) replace it with a comparable product, or (iii) refund the purchase price paid for the product. RefurbKings may take any other repair or corrective measures it deems necessary in its sole discretion. Replacement parts and products will be new or serviceably used, comparable in function and performance to the original parts or products, and warranted for the remainder of the Term. If Dakota PC repairs or replaces a product, the term of this Extended Warranty is NOT extended beyond the original Term.

2. Exclusions from Limited Warranty. This Limited Warranty covers the product only, and does not cover services rendered by RefurbKings. This Extended Warranty does not cover and RefurbKings is not responsible for: (i) damage due to external causes, including, but not limited to, accident, abuse, misuse, problems with electrical power and warranty service not authorized by Refurbkings; (ii) damage due to usage not in accordance with product instructions; (iii) damage due to failure to perform required preventive maintenance; (iv) damage due to use of parts

and components not supplied by RefurbKings; (v) any software that may be added to the product, whether by RefurbKings, Customer, or any third party; (vi) any equipment, components, parts, or accessories that were not included in the
product when originally sold to Customer; (vii) normal wear and tear; (viii) cosmetic damage that does not affect functionality of the product; (ix) minor imperfections in the product that do not materially alter functionality; and (x)

damage to or failure of any battery, whether new or used.

3. Customer Responsibilities. To obtain service pursuant to this Extended Warranty, Customer must: (i) abide by RefurbKings warranty service process; (ii) assist RefurbKings in diagnosing problems with the product; (iii) obtain
warranty services only from Refurbkings .(iv) remove any confidential, personal, or proprietary information and any removable media such as CDs or PC cards before providing the product to RefurbKings.

4. Programs, Data, Pictures and Other Information. Customer is solely and absolutely responsible for backing up programs, data, pictures and other information which may be stored in the product, if any, and Customer will be solely and absolutely responsible for any losses incurred because of a failure to properly back up programs, data, pictures and other information. It is possible that the contents of any component storing programs, data, pictures and other information will be lost or reformatted in the course of performance of warranty services, and Refurbkings will not be responsible for any damage to or loss of any programs, data, pictures or other information stored on any component of the product. Any illegal material encountered by RefurbKings while performing warranty services on the product will be reported to the appropriate law enforcement agency.

5. Replaced Parts. RefurbKings will own all parts removed from the repaired product. RefurbKings will retain as its property the replaced part that is removed in repairing the product.

6. Manufacturer’s Warranty. If there is a manufacturer’s warranty on the product in excess of the Term of this Extended Warranty, the manufacturer’s warranty will apply to the product and will be in lieu of this Extended Warranty. If there is a manufacturer’s warranty on the product that is less than the Term of this Extended Warranty, the manufacturer’s warranty will apply to the product for the term of the manufacturer’s warranty and this Extended Warranty will extend beyond the manufacturer’s warranty. If there is a manufacturer’s warranty, the term of this

Extended Warranty runs concurrently with the term of the manufacturer’s warranty. Customer is solely responsible for complying with all terms and conditions of any manufacturer’s warranty.

7. Governing Law; Venue. This Extended Warranty, and all terms and conditions set forth herein, will be governed by the laws of the State of Kentucky and, where applicable, the laws of the United States of America. Any and all disputes arising from this Extended Warranty, the product, Customer’s use of the product, or otherwise must be venued in the Circuit Court of the county in which Refurbkings store is located. Customer agrees to such venue and waives any challenge to such court’s jurisdiction based upon lack of personal jurisdiction or inconvenience.

8. LIMITATIONS OF WARRANTIES/REMEDIES. REFURBKINGS RESPONSIBILITY FOR DEFECTS IN MATERIALS AND WORKMANSHIP IS LIMITED SOLELY TO REPAIR, REPLACEMENT OR THE REFUND OF THE PURCHASE PRICE, AS SET FORTH IN THIS EXTENDED WARRANTY. THIS EXTENDED WARRANTY IS

THE ONLY WARRANTY MADE BY REFURBKINGS. THERE ARE NO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. REFURBKINGS WILL NOT BE LIABLE BEYOND THE REMEDIES SET FORTH IN THIS EXTENDED WARRANTY FOR ANY DAMAGES, INCLUDING,

BUT NOT LIMITED TO, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, SUCH AS LOST PROFITS OR REVENUES. DAKOTA PC WILL NOT BE LIABLE FOR THE PRODUCT NOT BEING AVAILABLE FOR USE, OR FOR LOSS OF PROGRAMS, DATA, PICTURES OR INFORMATION OF ANY KIND.

9. Customer Deliveries. Questions regarding warranty services or requests for warranty services, under this Extended Warranty must be directed to RefurbKings at 1038 East New Circle Rd. Lexington, Kentucky 40505.
To obtain warranty services, Customer must Provide the following items:

(1) The product in its original or equivalent packaging.

(2) The original or a copy of the sales receipt for the purchase of the product.

(3) Describe in detail the problem with or defect in the product.

(4) Provide RefurbKings with Customer’s name, address and other contact information.

(6) Sign a copy of RefurbKings Product Service Agreement or Computer Service Agreement, as applicable.

(7) Provide a copy of Customer’s Extended Limited Warranty.
